NAR Announces Settlement Agreement: A New Chapter in Real Estate Commission Practices

In a significant announcement, the National Association of REALTORS® (NAR) recently disclosed a groundbreaking agreement poised to reshape the landscape of real estate commission practices across the United States. Set to bring closure to prolonged litigation, this agreement marks a pivotal moment for both NAR members and consumers alike.

The crux of the agreement addresses claims pertaining to broker commissions, a matter that has been the subject of considerable legal contention. With over one million NAR members and numerous industry stakeholders involved, the settlement is a testament to NAR's commitment to fostering a fair and transparent real estate market.

Under the terms of the settlement, NAR will disburse $418 million over approximately four years, subject to court approval. Importantly, NAR maintains its stance of denying any wrongdoing concerning the Multiple Listing Service (MLS) cooperative compensation model, a cornerstone of the real estate industry since its introduction in the 1990s.

Nykia Wright, Interim CEO of NAR, underscored the association's dedication to preserving consumer choice and safeguarding the interests of its members. Key achievements of the resolution include the release of most NAR members and industry stakeholders from liability, alongside the retention of cooperative compensation as an option for consumers.

In addition to the financial settlement, NAR has committed to implementing pivotal changes to MLS rules. Notably, a new rule will prohibit offers of broker compensation on the MLS, while requiring MLS participants working with buyers to enter into written agreements with their clients. These measures, effective mid-July 2024, aim to enhance transparency and clarity in real estate transactions.
